Preamble
These Terms of Use (hereinafter the “Terms”) govern access to and use of the website accessible at omnissium.com (hereinafter the “Site”), published by:
Omnissium Sàrl, a limited liability company under Swiss law with a share capital of CHF 20,000, registered with the Commercial Register of the canton of Vaud under identification number CHE-160.141.024, whose registered office is located at Rue du Four 7, 1303 Penthaz (Switzerland) (hereinafter the “Publisher”).
Accessing and using the Site implies the user’s unreserved acceptance of these Terms (the user being hereinafter referred to as the “User”).
Article 1 — Purpose
The purpose of these Terms is to define the conditions under which the User may access the Site and use the information made available on it.
As of the date of publication hereof, the Site is a showcase website intended to present the Publisher’s business and the future SaaS platform “Omnissium” for market intelligence augmented by artificial intelligence (hereinafter the “Platform”). Access to the Platform, once opened, will be subject to separate contractual terms.
Article 2 — Access to the Site
The Site is freely accessible to any User with internet access. All costs related to such access (computer equipment, internet subscription, software) remain the sole responsibility of the User.
The Publisher takes reasonable steps to keep the Site accessible 24/7 but cannot be held liable for interruptions caused by maintenance operations, an event of force majeure, or any event beyond its control.
Article 3 — User conduct
The User undertakes to use the Site in compliance with:
- applicable laws and regulations, in particular Swiss law;
- these Terms;
- the rights of third parties, in particular intellectual property and privacy rights.
The User is in particular prohibited from:
- interfering with the operation of the Site (intrusion, denial of service, code injection, etc.);
- automatically collecting all or part of the Site’s data without prior written authorisation;
- distributing, from the Site, any unlawful, defamatory, abusive content or content contrary to public order;
- attempting to circumvent the security measures put in place by the Publisher.
Article 4 — Intellectual property
All elements present on the Site (texts, illustrations, logos, trademarks, photographs, videos, structure, source code, etc.) are protected by Swiss and international intellectual property laws, in particular the Swiss Federal Act on Copyright and Related Rights (CopA) and the Swiss Federal Act on the Protection of Trade Marks (TmPA). They remain the exclusive property of the Publisher or its partners.
Any reproduction, representation, modification, publication, adaptation, distribution or exploitation, in whole or in part, of these elements, by any means whatsoever, is strictly prohibited without the Publisher’s prior written authorisation.
Article 5 — Personal data
The processing of any personal data collected while browsing the Site is governed by the Publisher’s privacy policy, available at /en/confidentialite/. This policy is intended to comply with both the Swiss Federal Act on Data Protection (FADP) and, where applicable, Regulation (EU) 2016/679 (GDPR).
Article 6 — Cookies
In its current version, the Site places no cookies or trackers that are not strictly necessary on the User’s device. Any future change in this respect will be documented in the privacy policy.
Article 7 — Hyperlinks
The Site may contain links to third-party sites. The Publisher cannot be held liable for the content, products, services or data protection practices of such third-party sites.
The creation of hyperlinks to the Site is subject to the Publisher’s prior written consent.
Article 8 — Liability
The information published on the Site is provided for guidance only. The Publisher strives to ensure its accuracy and to keep it up to date, without however guaranteeing its completeness or the absence of errors. The User acknowledges using this information at their own risk.
To the fullest extent permitted by applicable law, the Publisher cannot be held liable for any direct or indirect damage resulting from the use of the Site or the inability to access it.
Article 9 — Amendment of the Terms
The Publisher reserves the right to amend these Terms at any time. The applicable Terms are those in force at the date of the User’s connection to and use of the Site. It is the User’s responsibility to consult the latest version of the Terms regularly.
Article 10 — Governing law and jurisdiction
These Terms are governed exclusively by Swiss law, to the exclusion of any conflict-of-law rules. Any dispute relating to their interpretation or performance shall, failing amicable resolution, fall within the exclusive jurisdiction of the ordinary courts of the canton of Vaud (Switzerland), subject to any mandatory provisions applicable to consumers.
